NYC Biodiesal Regulations Update

New York City Mayor Michael Bloomberg signed a bill into law last week that requires the city fleet to use a B5 biodiesel blend beginning July 1, 2014. Beginning July 1, 2016, the city fleet must use a B20 blend from April to November. The city will also launch a pilot program prior to December 1, 2016, to study year-round usage of B20 with no fewer than 5 percent of the city fleet.

Wall Street Journal reports:

The measure, introduced by Councilman Jim Gennaro, codifies the city’s existing use of biodiesel blends in the city’s fleet of approximately 6000 vehicles. The city’s Parks and Recreation Department has been using B5 for the last two years and began using B20 this year during warmer months.

The new law requires the city fleet to use a B5 biodiesel blend beginning July 1, 2014. Beginning July 1 2016, the city fleet must use a B20 blend from April to November. The city will also launch a pilot program prior to December 1, 2016 to study year round usage of B20 with no fewer than 5 percent of the city fleet.

Home to nearly 8,000 diesel vehicles, the city already uses biodiesel blends in almost all vehicles and in such prominent and key roles as Central Park management, snow removal and garbage collection. The city was an early adopter and is home to many of biodiesel’s biggest champions. A move to B20 would add up to 2 million gallons of biodiesel use annually.

EPA Launches New Online Mapping Tool for Environmental Impact Statements

WASHINGTON – Today, the Environmental Protection Agency (EPA) launched an interactive web-based mapping tool that provides the public with access and information on Environmental Impact Statements (EIS) filed with EPA for major projects proposed on federal lands and other proposed federal actions. When visiting the website, users can  click on any state for a list of EISs, , including information about the potential environmental, social and economic impacts of these projects.

The National Environmental Policy Act (NEPA) requires federal agencies to consider the impacts of proposed actions, as well as any reasonable alternatives as part of their decision-making process. For proposed projects with potentially significant impacts, federal agencies prepare a detailed Environmental Impact Statement which is filed with EPA and made available for public review and comment. EPA is required to review and comment on Environmental Impact Statements prepared by other federal agencies.

“This interactive tool makes it easier for the public to be informed about the environment around them,” said Cynthia Giles, assistant administrator for EPA’s Office of Enforcement and Compliance Assurance, which oversees NEPA compliance. “Major projects and decisions have the potential to affect the environment where you work and live. I encourage everyone to check out the tool, stay informed and lend your voice.”

The user can click on a state in the map and is provided with comment letters submitted by the EPA on Environmental Impact Statements within the last 60 days. The tool also provides users with the information they need to identify projects with open comment periods, including how to submit comments.

The tool supports EPA’s commitment to utilize advanced information technologies that help increase transparency of its enforcement and compliance programs. New Recommendations for Installing ASTs

AST systems continue to be important for commercial, emergency generator, agricultural and other similar applications. Especially in cases where there is room for them to be installed. When real estate is sparse, owners often must still rely on the more heavily regulated USTs. The Petroleum Equipment Institute (PEI) issued a new recommended practice for installing ASTs. PEI/RP200: Installation of Aboveground Storage Systems for Motor Vehicle Fueling, went through its most  recent review and finalized the sixth edition of the document in March 2013.

Reading through the recent article in the PEI Journal regarding RP200, here are some excerpts that spell out the biggest changes from their 2008 version:

  • Improvements in Fire Safety
  • Electronic gauges for all kinds of tanks
  • Better structural integrity of tanks
  • Technical updates to conform with UL 142 on tank capacity, length and diameter
  • Steel Tank Institute performance references updated to new STI standards

EPA Finalizes 2013 Renewable Fuel Standards to Help Promote American Energy Independence, Reduce Carbon Pollution

EPA also announces steps to address concerns about the E10 blend wall

As part of an ongoing effort to enhance energy security and reduce carbon pollution, the U.S. Environmental Protection Agency (EPA) today finalized the 2013 percentage standards for four fuel categories that are part of the Renewable Fuel Standard (RFS) program established by Congress. Most of these fuels are produced by American farmers and growers domestically and help reduce the carbon pollution that contributes to climate change.

The final 2013 overall volumes and standards require 16.55 billion gallons of renewable fuels to be blended into the U.S. fuel supply (a 9.74 percent blend). This standard specifically requires:

•           Biomass-based diesel (1.28 billion gallons; 1.13 percent)
•           Advanced biofuels (2.75 billion gallons; 1.62 percent)
•           Cellulosic biofuels (6.00 million gallons; 0.004 percent)

These standards reflect EPA’s updated production projections, which are informed by extensive engagement with industry and a thorough assessment of the biofuels market.

During this rulemaking, EPA received comments from a number of stakeholders concerning the “E10 blend wall.” Projected to occur in 2014, the “E10 blend wall” refers to the difficulty in incorporating ethanol into the fuel supply at volumes exceeding those achieved by the sale of nearly all gasoline as E10. Most gasoline sold in the U.S. today is E10. In the rule issued today, EPA is announcing that it will propose to use flexibilities in the RFS statute to reduce both the advanced biofuel and total renewable volumes in the forthcoming 2014 RFS volume requirement proposal.

EPA is also providing greater lead time and flexibility in complying with the 2013 volume requirements by extending the deadline to comply with the 2013 standards by four months, to June 30, 2014.

A January 2013 ruling by the U.S. Court of Appeals required the agency to reevaluate projections for cellulosic biofuel to reflect market conditions; the final 2013 standard for cellulosic biofuel announced today was developed in a manner consistent with the approach outlined in that ruling.

The Energy Independence and Security Act (EISA) established the RFS program and the annual renewable fuel volume targets, which steadily increase to an overall level of 36 billion gallons in 2022. To achieve these volumes, EPA calculates a percentage-based standard for the following year. Based on the standard, each refiner and importer determines the minimum volume of renewable fuel that it must ensure is used in its transportation fuel.

The TCEQ has been busy hearing public comments all over the state last week and this week. Did you submit comments?

The only comment I have heard so far from our Regulatory Affairs Manager is

115.241(b)(4) – Add TXP-101 as a test requirement. Some vapor space manifolds may have been achieved through the Vapor Return piping. One of the current proposed requirements is to disconnect the vapor return piping from the UST.

Take a look at the current Proposed revisions to Chapter 115, and let us know your thoughts. Keep in mind that they may change after hearing the public comments, commission requirements or getting final EPA approval.

TCEQ Proposing to Decommision Stage II Vapor Recovery

TCEQ have filed revisions to Chapter 115 with the Chief Clerk that will eliminate stage II Vapor Recovery systems on new UST installations and allow existing locations to remove the Stage II Vapor Recovery systems. These revisions have to be approved by the commission before being submitted to the Texas Register for public comment. Typically they will be adopted by the commission 20 days after they are submitted to the Texas Register.

Texas has also submitted a revised State Implementation Plan with the EPA. Upon EPA Approval and adoption by the commission the revisions will be made to Chapter 115.

EPA Will Propose Achievable Cleaner Fuels and Cars Standard, Slashing Air Pollution and Providing Extensive Health Benefits

WASHINGTON – Based on extensive input from auto manufactures, refiners, and states, the U.S. Environmental Protection Agency (EPA) today proposed sensible standards for cars and gasoline that will significantly reduce harmful pollution, prevent thousands of premature deaths and illnesses, while also enabling efficiency improvements in the cars and trucks we drive. These cleaner fuels and cars standards are an important component of the administration’s national program for clean cars and trucks, which also include historic fuel efficiency standards that are saving new vehicle owners at the gas pump today. Once fully in place, the standards will help avoid up to 2,400 premature deaths per year and 23,000 cases of respiratory ailments in children.

Following a proven systems approach that addresses vehicles and fuels as an integrated system, today’s proposal will enable the greatest pollution reductions at the lowest cost. The proposal will slash emissions of a range of harmful pollutants that can cause premature death and respiratory illnesses,  including reducing smog-forming volatile organic compounds and nitrogen oxides by 80 percent, establish a 70 percent tighter particulate matter standard, and reduce fuel vapor emissions to near zero.  The proposal will also reduce vehicle emissions of toxic air pollutants, such as benzene and 1,3-butadiene, by up to 40 percent.

The proposal supports efforts by states to reduce harmful levels of smog and soot and eases their ability to attain and maintain science-based national ambient air quality standards to protect public health, while also providing flexibilities for small businesses, including hardship provisions and additional lead time for compliance.

“The Obama Administration has taken a series of steps to reinvigorate the auto industry and ensure that the cars of tomorrow are cleaner, more efficient and saving drivers money at the pump and these common-sense cleaner fuels and cars standards are another example of how we can protect the environment and public health in an affordable and practical way,” said EPA Acting Administrator Bob Perciasepe. “Today’s proposed standards – which will save thousands of lives and protect the most vulnerable — are the next step in our work to protect public health and will provide the automotive industry with the certainty they need to offer the same car models in all 50 states.

By 2030, EPA estimates that the proposed cleaner fuels and cars program will annually prevent up to 2,400 premature deaths, 23,000 cases of respiratory ailments in children, 3,200 hospital admissions and asthma-related emergency room visits, and 1.8 million lost school days, work days and days when activities would be restricted due to air pollution. Total health-related benefits in 2030 will be between $8 and $23 billion annually.  The program would also reduce exposure to pollution near roads. More than 50 million people live, work, or go to school in close proximity to high-traffic roadways, and the average American spends more than one hour traveling along roads each day.

Throughout the development of the proposal, EPA met with representatives from the automotive and oil and gas industry as well as environmental, consumer advocacy and public health organizations.  Based on initial feedback from these groups and a thorough rulemaking process, EPA’s proposal is estimated to provide up to seven dollars in health benefits for every dollar spent to meet the standards. The proposed sulfur standards will cost refineries less than a penny per gallon of gasoline on average once the standards are fully in place.
The proposed vehicle standards will have an average cost of about $130 per vehicle in 2025. The proposal also includes flexibilities for small businesses, including hardship provisions and additional lead time for compliance.

The proposed standards will reduce gasoline sulfur levels by more than 60 percent – down to 10 parts per million (ppm) in 2017. Reducing sulfur in gasoline enables vehicle emission control technologies to perform more efficiently.  This means that vehicles built prior to the proposed standards will run cleaner on the new low-sulfur gas, providing significant and immediate benefits by reducing emissions from every gas-powered vehicle on the road.

The proposed standards will work together with California’s clean cars and fuels program to create a harmonized nationwide vehicle emissions program that enables automakers to sell the same vehicles in all 50 states. The proposal is designed to be implemented over the same timeframe as the next phase of EPA’s national program to reduce greenhouse gas (GHG) emissions from cars and light trucks beginning in model year 2017. Together, the federal and California standards will maximize reductions in GHGs, air pollutants and air toxics from cars and light trucks while providing automakers regulatory certainty and streamlining compliance.

Once published in the Federal Register, the proposal will be available for public comment and EPA will hold public hearings to receive further public input.

Brian Harmon, our Regulatory Affairs Manager, confirmed the following Michigan  Regulatory Requirements. Here are some notes regarding Monthly Inspections and Line Leak Detectors. Do you have Underground Storage Tanks in Michigan? TAIT is a licensed Michigan UST Class B Operator that conducts monthly inspections, testing, repairs and even tank installations, removals, and remediation. Monthly Inspections

The site will have to print out or log the monthly results from the type of release detection they have on site. Examples are:

1)      If the electronic monitoring panel is conducting monthly tank testing the results should be printed out.

2)      If the site is using Interstitial monitoring then a monthly Alarm History Report should be printed out.

3)      If the site is conducting Vapor Monitoring, Groundwater Monitoring or Visual  Monitoring then the inspection logs should be filled out monthly.


The location should have a log to identify any repairs conducted on the UST system and/or the Release Detection equipment.

All of these results and/or logs have to be on site when the Class B Operator conducts his inspection so he can verify the information or identify any issues.

Site personnel can print out the monthly electronic results or conduct any monthly inspections when properly trained. The state requires that a Class B Operator conduct an inspection at least every quarter. The inspection frequency can be shorter if desired.

Line Leak Detectors for pressurized lines

Pressurized lines have to have an LLD (mechanical or electronic).

They have to conduct an Annual Product Line test OR have sensors that trigger an alarm in every sump OR  have an electronic line monitor that can conduct a 0.08GPH test at normal operating pressure.

Also FYI, if a pressurized system has Secondary containment, has sensors installed in all sumps and UDCs AND  the sensors will shut off product flow when the detect any liquid (Fuel or water) then an LLD is not required to be installed.

TAIT’s Alaska A/B UST Operator Training

The State of Alaska’s Department of Environmental Conservation required all operators in Alaska receive training and become certified by 12/31/12If operators are not certified by this date, the owner and/or operator may be subject to penalties.  A record of each operator’s certificate must be kept onsite. Additionally, a copy of each Class A and/or B operator’s training certificate, along with a current Class A/B facility operator designation form, must be submitted to department’s UST staff ensure the facility’s records are properly updated.
