New Mexico Public Hearing on Proposed PST Regulations

As discussed in an earlier post, New Mexico PST regulations are being revised.  The New Mexico Environmental Improvement Board is holding a public hearing to consider proposed amendments to the Petroleum Storage Tank Regulations including:

  • General Provisions
  • Registration of Tanks
  • New and Upgraded Storage Tank Systems
  • General Operating Requirements
  • Release Detection
  • Reporting and Investigation of Releases
  • Administrative Review
  • Corrective Action
  • Certification of Tank Installers
  • Operator Training
  • Delivery Prohibition

New Mexico Proposed PST Regulations

New Mexico proposed regulations governing Petroleum Storage Tanks (PSTs).   Here is a good slideshow that was presented at the public hearings held in May.  The proposed final version should be available in June 2011.  Comments will be accepted after that or attend a public hearing expected to be in October 2011.

New Mexico Legislation Redefining USTs and ASTs

The State of New Mexico has passed House Bill 81, which amends the definition of USTs and ASTs.  Previously, the New Mexico Petroleum Storage Tanks General Provisions specifically exempted USTs and ASTs that were associated with emergency generator systems. House Bill 81 removed the emergency generator exemption so that the State’s regulations will be compliant with Federal EPA and the 2005 Energy Policy Act.  The regulations are not yet promulgated, but as soon as they are, we will add a post here.
