Oregon DEQ Tankline Bulletin

Oregon DEQ has issued a Tankline Bulletin (January 2022). In this issue, Oregon DEQ summarizes the updated process for approving UST fuel drops at for testing newly-installed USTs to ensure that fuel drop requests are handled consistently.

The bulletin also covers DEQ’s Air Quality (AQ) program that regulates all gasoline dispensing facilities (GDFs) to reduce the emission of gasoline vapors. Regardless of whether or not your facility has a GDF permit, if you dispense gasoline, your UST or AST facility is subject to the National Emission Standards for Hazardous Air Pollutants rules. Have you opened your turbine sump and noticed a persistent odor of gasoline? You are probably in violation of OAR 3402440240 (1), which states: the owner or operator of a GDF must not allow gasoline to be handled in a manner that would result in vapor releases to the atmosphere for extended periods of time.

Kansas UST Operator Training Extension due to COVID-19

The Kansas Department of Health and Environment (KDHE) acknowledges that travel plans may be altered due to the precautions to prevent the spread of the coronavirus (COVID-19). In the event a trainee or Operator is hesitant about traveling to an Operator Training venue or the classroom training event is canceled, the trainee or Operator may request an extension of the Class A/B Operator Training for up to 6 months past their initial due date, certificate expiration date, or re-training date. An Operator Training Request for Extension Form must be completed, signed and submitted to KDHE for review and approval prior to the trainee’s or Operator’s required certification due date or expiration date. TCEQ Proposed Petroleum Storage Tank Rules



On Nov. 15, 2017, TCEQ commissioners approved publication of the proposed rules for petroleum storage tanks.

The proposed rulemaking amends Title 30 Texas Administrative Code (TAC) Chapter 334. This required rulemaking will incorporate necessary changes to 30 TAC Chapter 334 in accordance with the EPA’s 2015 revisions to the federal underground storage tank (UST) regulations in Title 40 Code of Federal Regulations Part 280.

The rule revisions include:

  • Periodic operation and maintenance requirements for UST systems to conduct walkthrough inspections and test UST system components,
  • New requirements to annually test specific release-detection equipment,
  • Changes to comply with existing EPA release-detection requirements to monitor at least every 30 days (instead of every 35 days), and
  • Minor rule revisions relating to the fee on delivery of petroleum products to reflect changes that were statutorily implemented in the Texas Water Code in 2015.

The public comment period will be Dec. 1, 2017 through Jan. 9, 2018. Comments may be submitted electronically beginning Dec. 1, 2017.

A formal public rule hearing is also scheduled for 2:00 p.m. on Jan. 9, 2018, at the TCEQ’s Central Office located at 12100 Park 35 Circle, Austin, TX 78753, in Building E, Conference Room 201S.

* If a class has been scheduled, but less than 10 attendees have registered within 72 hours of the class date, that class will be cancelled, and registrants will be moved to the next available date for UST Operator Training in their area.

Most UST Operators were trained by the Wednesday, August 8, 2012 – DEADLINE. The course must be re-taken every three years. The Texas Commission on Environmental Quality required AB UST Operator Training be completed by August 8, 2012. The TCEQ has recently begun to send letters to over 10,000 UST facility owners regarding their compliance with the UST Operator Training requirements. They track compliance with the training requirement through the Self-Certification process – requiring owners to list the names and training certificate number or a copy of the certificate be included with the annual filing.

UST Training course for AB Operators in Texas

EPA has requested the TCEQ verify the compliance rate since the TCEQ could only provide information that about half of the UST owners had proven compliance with the training requirement.

The TFFA, our training partner along with 360 training, prepared Regulatory Alert #546  so TFFA members could forward the information and the Regulatory Alert to their customers that own and operate underground storage tanks. It is likely the TCEQ will soon target enforcement against those facility owners who fail to respond to the agency’s letter.

334.603(b) – states 72 hours:Owners and operators of underground storage tank facilities (except unmanned facilities) must maintain required training certification documentation as described in §334.603(b) of this title (relating to Acceptable Operator Training and Certification Processes) on-site and must provide it upon request to a Texas Commission on Environmental Quality (TCEQ) or TCEQ-authorized investigator. Documentation may be maintained electronically off-site if that facility has the capability of producing a clear printed copy which can be provided to a TCEQ or TCEQ-authorized investigator within 72 hours of the time of the investigation. Owners and operators of unmanned facilities must provide documentation as requested by a TCEQ investigator or TCEQ-authorized investigator.
